Aledo City Council Agenda Feb. 28, 2008CITY OF ALEDO, TEXAS Thursday, February 28, 2008 CALL TO ORDER INVOCATION AND PLEDGE OF ALLEGIANCE PRESENTATIONS Presentation to Mr. Gentry “Ace” Little on KYQX Radio for his coverage of the City of Aledo. CONSENT AGENDA All of the following items on the consent agenda are considered to be self-explanatory by the Council and will be enacted with one motion. There will be no separate discussion of these items unless a Council Member so requests. Approval of the consent agenda authorizes the City Administrator to implement each item in accordance with the staff recommendation. a. Regular City Council Minutes of January 24, 2008. b. Special City Council/Workshop Minutes of January 26, 2008. c. Monthly financial statements. Consideration of a Preliminary Plat / Replat for Aledo Town Village on a 2.57 acre tract, being located at LR Fawks Survey, Abstract 483, and a portion of the Original Town of Aledo, Block 4, Lots 2-6, located in the City of Aledo, Parker County, Texas. PLANNING AND ZONING RECOMMENDATIONS 2. Consideration and action on a Preliminary Plat / Replat for Aledo Town Village on a 2.57 acre tract, being located at LR Fawks Survey, Abstract 483, and a portion of the Original Town of Aledo, Block 4, Lots 2-6, located in the City of Aledo, Parker County, Texas. OTHER ITEMS FOR CONSIDERATION 3. Consideration of Interlocal agreement with Fort Worth for a Sewer Feasibility Study. 4. Consideration and action on findings of hydraulic analysis of water system completed by Freese and Nichols. 5. Consideration and action regarding engineering agreement with Freese and Nichols on Fort Worth Water System Design. 6. Consideration and action on request from Mr. Tim Foster of Aledo Broadband to request a waiver of $7,230.39 for lease payments for the use of the City tower from April 2004 to December 2007. 7. Consideration and action on approval of Texas Safe Routes to School Program Grant Agreement to include Resolution No. 2008-01. 8. Consideration and action regarding technical report from Apex Geoscience, Inc. in regards to slope stability at the Wastewater Treatment Plant. 9. Consideration and action regarding a request for approval of the race route for the Aledo Advocats 5k Run to be held April 19, 2008. 10. Consideration and action on award of bid for conveyance of an easement of a 20 foot x 20 foot section of the Original Town Aledo, located in and being a portion of Fannin Street and Block 24. 11. Consideration and action to reschedule the location of the March 2008 City Council meeting due to scheduling conflicts. 12. Consideration and action on budget amendments. 13. Consideration and action on acceptance of resignation of Fire Marshal Gary Cochran. 14. Consideration and action on appointment of Mr. Lyle Lombard as the part-time City Fire Marshal. 15. Discussion regarding Citizen’s Committee for the Parker County Transportation Coalition. 16. Consideration and action on approving a budget of $5,000 for 4B election information materials and brochure development. BOARD AND COMMISSIONS 17. Consideration and action on Ordinance No. C-2008-02 relating to the duties of the Park and Recreation Board. 18. Consideration and action regarding reappointment of members in places 1, 3, 5 and 7 on the Planning and Zoning Commission. 19. Consideration and action on appointment of Chairperson and ratification of Vice-Chairperson for the Planning and Zoning Commission. ELECTIONS 20. Consideration and action on Resolution No. 2008-02 calling the May 10, 2008 General Election and establishing the necessary procedures for conducting the election. 21. Consideration to approve a contract for election services with Parker County Elections Administration between the City of Aledo, Aledo Independent School District and Parker County. 22. Consideration on a voting machine rental agreement. 23. Consideration of the rental agreement of early voting equipment. REPORTS 24. Update on gas pipeline regulations. 25. Update on Inter-local agreement with Aledo ISD regarding municipal court citations. 26. Update from Urban Land Institute. 27. Update on Texas Water Development Board presentation on the Fort Worth Water Project. 28. Update regarding Texas Community Development Block Grant program for Lasater Sewer Improvement Project extension. 29. Update regarding Willow Park’s loan application for a Regional Sewer Plant. 30. Update on extraterritorial jurisdiction agreements with Parker County. 31. Update regarding Bearcat Park restroom facilities. 32. Update on Budget – Law Enforcement Options. 33. Report on Website and Logo development. 34. Report on staffing update. 35. Monthly department reports. COUNCIL AND STAFF COMMENTS (In compliance with the Texas Open Meetings Act, Council members may comment on routine city matters, may ask questions of staff that require only responses of factual information or statements of existing city policy, or may request that non-routine matters of public concern be placed on a future agenda. Council members may not discuss non-agenda items among themselves. In compliance with the Texas Open Meetings Act, city staff members may comment on routine city operations and projects. Staff members may respond to questions from others only with statements of factual information or existing city policy.) EXECUTIVE SESSION 36. The City Council for the City of Aledo, Texas, will convene into Executive Session pursuant to the Texas Government Code, Chapter 551 to discuss the following: 551.07l CONSULTATION WITH ATTORNEY – SEEK ADVICE REGARDING PENDING OR CONTEMPLATED LITIGATION, A SETTLEMENT OFFER, OR ON A MATTER IN WHICH THE DUTY OF THE ATTORNEY TO THE GOVERNMENTAL BODY UNDER THE TEXAS DISCIPLINARY RULES OF PROFESSIONAL CONDUCT OF THE STATE BAR OF TEXAS CLEARLY CONFLICTS WITH THIS CHAPTER, NAMELY: a) State Office of Administrative Hearings Docket No. 582-06-0947, TCEQ Docket No. 2005-1531-UCR – Application of the City of Willow Park to Transfer CCN Nos. 12027 and 20849 from Deer Creek Waterworks, Inc., and to Amend Willow Park CCN Nos. 11814 and 20773. b) State Office of Administrative Hearings Docket No. 582-07-3998; TCEQ Docket No. 2007-0020-MWD: Application by the City of Aledo for an amendment to TPDES Permit No. WQ0010847001. 1) Settlement Agreement with Tarrant Regional Water District. c) City of Willow Park, Texas v. City of Aledo, Texas, et. al., No. CV07-2129, 43rd District Court, Parker County, Texas. 551.074 AUTHORIZING CERTAIN DELIBERATIONS PERTAINING TO THE APPOINTMENT, EMPLOYMENT, EVALUATION, REASSIGNMENT, DUTIES, DISCIPLINE, OR DISMISSAL OF A PUBLIC OFFICER OR EMPLOYEE. d) Discussion and update on possible legal action directed at Mr. Mack Wofford. 551.072 DELIBERATION REGARDING REAL PROPERTY – to deliberate the purchase, exchange, lease, or value of real property.
